Terms & Conditions
YOUR STATUTORY RIGHTS AS A CONSUMER ARE NOT AFFECTED BY THE TERMS OF THIS AGREEMENT.
1. Estimates and Fees
1.1. A Staged Moves Consultant (“Staged Moves”) shall attend the Client’s property (the “property”) to carry out an initial consultation (the “consultation”) with the Client and if required, prepare a full written report (the “report”). 1.2. Staged Moves shall not charge for the consultation, but will charge £------ for the report (if required). The client shall pay these fees in advance of services supplied. 1.3. If the Client requires the full supervisory services of Staged Moves, a further appointment will be made to discuss the full scope of the works required. 1.4. A full Schedule of works (the “schedule”) with estimated costings would be made and forwarded to the client, with a copy of these terms and conditions for their approval. 1.5. If the client wishes to proceed, he/she must return a copy of the schedule duly signed to confirm their agreement to the estimate and these terms and conditions. 1.6. The schedule shall include a general description of services, goods and materials deemed necessary to achieve the best results. It will include our estimated charges pursuant to clause 1.7. However, Staged Moves may need to vary the services required as works progress. All additional works will be agreed with client prior to commencement. In all other cases, the client shall not be liable to pay any sum in excess of the price set out in the schedule (excluding provisional items – see clause 1.9) unless previously agreed. 1.7. Staged Moves shall charge £35.00 per hour for each property presentation consultant or £225.00 per day, subject to clients needs. It may sometimes be necessary to use an assistant, to be charged at £25.00 per hour. All hours will be broken down in the schedule and agreed with the client before commencement of works. 1.8. All trade persons required during the works and any contracts or agreements made with said trade persons would be made directly by the client. 1.9. The schedule may contain items stated as provisional sums. This means that the cost of the item is unknown at the date of the Estimate. Staged Moves will endeavour to ascertain such costs and agree it with the client before purchase. 1.10. Any changes made to the schedule by the client will be deemed agreed by both parties once work commences and liable to the above hourly or daily fees as necessary. 1.11. The client may cancel the contract at any time by giving notice in writing to Staged Moves at its usual business address. In this case, the client shall be liable to pay Staged Moves for the services provided including all works carried out and goods and materials supplied or ordered on the client’s behalf to the date of cancellation.
2. Timescales
2.1. As soon as it is able to do so, Staged Moves shall specify the date on which it intends to commence the services and the estimated completion date. All such dates shall be approximate only and while Staged Moves shall use its reasonable endeavours to meet the estimated completion date, Staged Moves shall not be liable for any delay in completion and time shall not be of the essence of the agreement.
Clients Obligations
3. The Client Shall: 3.1. Permit Staged Moves, its employees, and other appointed representatives access to the property at all reasonable times for the purposes of providing the services, delivering goods and materials and/or carrying out works; 3.2. Ensure a supply of water and power at the property, sufficient for the purpose of carrying out works and such services shall be supplied at no cost to Staged Moves. 3.3. Be responsible for any loss or damage to any goods, materials, tools or equipment delivered to or stored at the property, except to the extent that such damage arises from Staged Moves failure to take reasonable care; and 3.4. Be responsible for home contents insurance to cover all items loaned to the client by Staged Moves for the entire duration of the loan, including but not limited to, antique furniture.
4. Staged Moves Obligation
4.1. Any goods and materials supplied by Staged Moves shall be of satisfactory quality and fit for the purpose. 4.2. If the client requires any particular goods and materials to be supplied by Staged Moves, he/she must provide written details of these when returning the estimate pursuant to clause 1.5. In the absence of such specification, the goods and materials supplied shall be selected at Staged Moves absolute discretion and the client shall not be entitled to reject goods and materials selected by Staged Moves unless they have been supplied in breach of clause 4.1 4.3. If the client requests that Staged Moves use goods or materials supplied by him/her for the purpose of providing the services, Staged Moves shall do so on the strict understanding that Staged Moves has no responsibility as to their quality or suitability. Any losses or damages, which may follow from the use of such goods or materials, will be the sole responsibility of the client. 4.4. Staged Moves shall provide the services using reasonable care and skill. 4.5. Staged Moves shall not be liable for any defect in any goods and materials supplied and any works carried out which arise from fair wear and tear, wilful damage, negligence of the client, failure to follow Staged Moves instructions (whether oral or in writing) or alterations made without Staged Moves approval. 4.6. Staged Moves is under no obligation to produce receipts to the client for goods or materials supplied, except in the case of electrical appliances which are under the manufactures guarantee. 4.7. Whilst the services supplied by Staged Moves are designed to make the property more marketable, Staged Moves gives no guarantee that the property will be sold or rented following completion of the services.
5. Payment
5.1. When enlisted for the full service, Unless otherwise agreed in writing by Staged Moves, a payment equivalent to 50% of the estimated fee and any props and accessories that you wish purchased on your behalf shall be payable prior to commencement of the works. All Props and accessories, unless unforeseen, will be listed on the schedule. The client should note that commencement of the works and supply of the goods and materials will not take place until Staged Moves has received this payment in cleared funds. 5.2. The balance of the total price shall be payable upon completion of the contract. 5.3. Payments can be may be made in cash, by bank draft, by cheque or by credit / debit card via PayPal. 5.4. Should the client fail to pay, Staged Moves may, without prejudice, charge the client interest at the rate of 2% per annum above the Bank of England Base Rate from the due date until payment is made.
6. General
6.1. This agreement supersedes any prior agreement (oral or in writing) between the parties. The parties acknowledge that this agreement contains the whole agreement between them and that the client has not relied upon any oral or written representations made by Staged Moves or its employees or agents. 6.2. Staged moves shall not be liable for any failure to perform its obligations under this agreement due to unforeseen circumstances or beyond its control, including without limitation, adverse weather conditions, flood or fire. 6.3. This agreement shall be governed by English law and the parties shall submit any dispute arising hereunder to the exclusive jurisdiction of the English courts,
